Maternidade digna – Marco Legal da Primeira Infância

Em 2016, o Brasil aprovou o Marco Legal da Primeira Infância, que entre outras proteções a crianças de até 6 anos, modificou o artigo 318 do Código de Processo Penal para incluir novas hipóteses de prisão domiciliar.

Além dos casos de pessoas acima de 80 anos, com doenças crônicas, mães com filhos menores de 6 anos, com deficiência ou dependentes de cuidados especiais, situações já previstas na lei, o dispositivo passou a assegurar prisão domiciliar também a mulheres gestantes, mães com ao menos um filho até 12 anos, e também a homens com ao menos um filho da mesma idade, quando caracterizado serem eles o único responsável pela criança.

“Toda mulher tem direito de exercer a maternidade de maneira digna. Essas mulheres são capazes de amar seus filhos e nós temos que propiciar que isso aconteça de uma maneira digna, respeitando seus direitos e os direitos das crianças”, defende o advogado Pedro Hartung, coordenador do programa Prioridade Absoluta, do Instituto Alana, organização da sociedade civil que atuou como amicus curiae no julgamento da ação no STF.

“Essas mulheres são capazes de amar seus filhos e nós temos que propiciar que isso aconteça de uma maneira digna, respeitando seus direitos e os direitos das crianças”, Pedro Hartung, advogado e coordenador do programa Prioridade Absoluta, do Instituto Alana.

O advogado explica que a decisão do Supremo favorece principalmente as crianças, para que elas possam ter um desenvolvimento adequado e sadio ao lado das mães. “Nenhuma criança merece passar um dia sequer dentro de um presídio.”

A gente sabe que as condições nos presídios femininos são insalubres, com altos índices de doenças transmissíveis como tuberculose, aids, nenhuma criança merece ter esse tratamento assim que chega ao mundo”, diz.

Segundo o Instituto Alana, na ocasião da votação do habeas corpus, cerca de 2 mil crianças estavam com as mães em presídios no país, e somente 121 tinham acesso a espaços adequados.
